1.1 We reserve the right to change these terms and conditions at any time. Any such changes will take effect when posted on the website (see the date at the top) and it is your responsibility to read the terms and conditions on each occasion you use this website and your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions.
1.2 If you are not a consumer, you confirm that you have the authority to bind any business on whose behalf you use this website.
2. Order process
2.1 Acceptance of your order and the completion of the contract between you and us will take place on dispatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled it (please refer to Returns, Cancellations and Substitutions).
2.2 You can find the file details of your order by logging into your user account, however, please print out these terms and conditions and the order acknowledgement for your own records. 3.1 We have four delivery options available which can be selected in the checkout. These are Economy, Standard, Express and our White Glove Service. All goods must be signed for by an adult aged 18 years or over on delivery. Delivery will be direct to the purchasers address.
3.2 We make every effort to deliver goods within 10 days of receipt of your order; however, delays are occasionally inevitable due to unforeseen factors. SASAKI shall be under no liability for any delay or failure to deliver the product within estimated timescales.
3.3 We are complied with the United Kingdom’s Distance Selling Regulations (DSRs), the statutory time limit for delivery of goods is 30 days from the day after the day the consumer sends the order to us.
3.4 If we cannot meet the 30-day deadline to deliver the goods, we will inform the consumer before the expiry of the deadline and a revised date for delivery.
3.5 Risk of loss and damage of products passes to you on the date when the products are delivered or on the date of first attempted delivery by us.
4.1 We take payment from your card or finance payment at the time we receive your order, once we have checked your card details, payment status from our finance company and stock availability. Goods are subject to availability. In the event that we are unable to supply the goods, we will inform you of this as soon as possible. A full refund will be given where you have already paid for the goods.
4.2 The price you pay is the price displayed on this website at the time we receive your order. However, while we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact with you, we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.
4.3 Title to any product you order on this website shall pass to you on delivery of the product provided that we have processed and received payment in full for the products.
4.4 All prices are shown in £s sterling and include VAT.
4.5 All Prices can change instantly and with no advanced warning.
4.6 For security reasons, please enter your cardholder address as your billing address during the checkout process. You have the option to enter a delivery address if the goods are not delivered to the billing address.
4.7 If you would rather talk to one of our staff before placing your order, or you are nervous about using your credit/debit card or processing a finance payment application on the internet, then don’t worry. Please call us at 0845 330 6369 and we will contact you to take your order and payment.
5. Returns, Cancellations and Substitutions
5.1 You have the right to cancel the contract for the purchase, unless otherwise stated, within a period of 14 days, beginning with the day after the day on which the item is delivered.
5.2 You must inform us within two working days if the goods are lost or damaged in transit so that we can make a prompt claim against the delivery company and correct the problem. Please quote your order number in all correspondence and contact us on 0845 330 6369 directly.
5.3 To cancel the order, please inform us with a description of your details, your Order Reference Number (or document no) and reasons for return in writing, unless otherwise stated, within a period of 14 days. This includes a letter, fax or email. A phone call is not enough to accept an order cancellation. We shall issue a reference number for the return of the order (reference number is valid for 7 days only). No goods will be accepted for return without quoted the given reference number on the parcel. If you do not write to us within 14 days, unless otherwise stated, for the return (telephone is not good enough) or do not return the products more than 7 days after informing us in writing, we may arrange for them to be collected from you and you will be charged the costs we incur in making such collection (unless the product delivered to you were incorrect or were delivered in a damaged or faulty state).
5.4 When you return the order back to us, please pack the relevant item securely attached with a description of your details and reasons for cancellation. The goods must be returned to us within 7 days after the notification has been logged. On the parcel, please include the Return Reference no. and send to: SASAKI International Ltd, Unit 1, Maple Business Park, Walter Street, Birmingham B7 5ET, United Kingdom.
5.5 No cancellation of order will be accepted after 14 days from delivery of goods unless otherwise stated.
5.6 Our 14 days online return, unless otherwise stated, applies to goods purchased for domestic use only. These options do not apply to equipment purchased for use by a business.
5.7 To ensure the safe return of the merchandise, we suggest that you return any item with a tracking number. Please note that you will be responsible for the costs of returning the goods to us unless we delivered the item to you in error or the item is faulty.
5.8 To be eligible for a refund, you must return your item to SASAKI in the same condition you received it.
5.9 SASAKI may issue full or partial refunds for an order, purchase price minus Postage & Packing. All goods should be returned complete with product accessories (if any) and in their original packaging and with no signs of damage, otherwise, we may reduce the amount of the refund and reserve the right to charge a restocking fee of up to 30% if the goods are not returned as stated.
5.10 Any free gifts received with your order must be returned if an order is cancelled, otherwise, we may reduce the amount of the refund.
5.11 Refunds will be made within 28 days of receipt of the product at the SASAKI warehouse.
6.1 All new equipment sold online by Sasaki International unless otherwise stated, are covered by a 12 months warranty.
6.1.1 All ex-display and ex-demo equipment sold online by Sasaki International, unless otherwise stated, are covered by a 3 months warranty.
6.1.2 The warranty can be valid up to 7 years from the date of delivery subject to the purchase terms.
6.1.3 The warranty will only apply to products delivered and installed by Sasaki International Ltd.
6.2 If an item develops a fault, please e-mail firstname.lastname@example.org, stating the equipment you have, brand name (if available), model number (if available), serial number (if available) and a brief description of the fault.
6.3 Extended warranty may be available, please contact Sasaki for more details.
6.4 If the product develops a fault within the warranty period, you will be responsible for the costs of returning the product to us for repair.
6.4.1 The warranty covers all mechanical parts. Items which have a natural limited lifetime or durability or any fabric wear and tear or damage will not be included.
6.4.2 After the first year, callout charge per mileage will be applied for each site visit or the product can be returned to Sasaki International Ltd at the owner’s own expense.
6.5 The warranty is voided if the equipment(s) is/are not stored in the delivery address on the customer invoice.
6.5.1 In the event that the product is resold, the full details of the new owner must be registered with Sasaki International within 10 days of the change of ownership. Failure to inform Sasaki International Ltd of change of ownership will invalidate the warranty.
6.6 The following conditions will be considered as a customer expense for the cost of the repair within the warranty period.
• Damage or defect is caused by improper use or abnormal use of the unit;
• Damage or defect is caused by the user or third parties;
• Damage or defect which does not influence significantly the function or the value of the unit;
• Damage or defect of plastic/rubber parts for cosmetic purposes;
• Damage or defect is caused by pollution or incorrect maintenance;
• Damage or defect is not arisen from the unit itself;
• Professional/commercial use of units manufactured for domestic use;
• Repairs or attempted repairs by third parties;
• A simple repair (e.g. replacing a fuse on a plug);
• Normal wear and tear from use and
• Scratches, scrapes or dents.
6.7 The product must be serviced by Sasaki International on a yearly basis. This service will be charged at our normal Service Charge rate. Service or repair by a third party will invalidate the warranty.
6.8 This in no way affects your statutory rights.
7. Quality and Use of Equipment
7.1 We make every effort to ensure that the product marketed by us is of the highest quality. We are governed by the manufacturer’s ability to provide the quality of a product. There are times when this may be beyond our control. We make every effort to ensure that the purpose for which the product is advertised is the correct one. Equipment must at all times be used in conjunction with the manufacturer’s instructions, please read carefully before use.
7.2 The product we sell is suitable for most adults. If however, you are pregnant, have undergone major surgical procedures, or suffer from any pre-existing medical conditions we recommend that you first consult your doctor or specialist before purchasing from us.
7.3 All pictures shown are for illustration only. The actual product may vary slightly due to manufacturers enhancements.
10. WEEE Policy
10.1 Following international agreement on the basic principles of protecting the environment from hazardous substances released by Electrical and Electronic Equipment at the end of its life, the European Parliament introduced Directives calling for all member states to pass legislation to recycle these goods at the end of their useful life.
The directive responsible for promoting the safe disposal and/or recycling of Waste Electrical and Electronic Equipment at the end of its life is generally referred to as the WEEE directive.
10.2 Sasaki International Ltd offer customers a free in-store take back of old WEEE items on a like for like basis. Customers can return their old items within 28 days of purchasing an equivalent new item. The old items will be returned to a producer compliance scheme or a local waste carrier and disposed of in a safe manner.
Some WEEE may contain significantly higher amounts of hazardous substances than if they were manufactured today. The hazardous substances present in such WEEE items can damage both human health and the environment if left in landfill sites.
10.3 Products produced after August 2005 will be marked with a crossed-out wheelie bin symbol:
10.4 When these products are no longer required, they should be disposed of separately from household waste.
11. Liability and Indemnity
11.1 Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation, or any other liability which may not otherwise be limited or excluded under applicable law.
11.2 Subject to Section 11.1 above, SASAKI will use reasonable endeavours to verify the accuracy of any information on the site but makes no representation or warranty of any kind express or implied statutory or otherwise regarding the contents or availability of the site or that it will be timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the website SASAKI will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the website and SASAKI accepts no liability of any kind for any loss or damage from action taken or taken in reliance on material or information contained on the site.
11.3 Subject to Section 11.1 above, other than as expressly provided in these terms and conditions with respect to specific products and except for the exclusive remedies set out in Section 5 above, any indemnities, warranties, terms and conditions (whether express or implied) are hereby excluded to the fullest extent permitted under the applicable law.
11.4 Subject to Section 11.1 above, SASAKI will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent on negligent misrepresentations) or otherwise out of or in connection with the terms and conditions for any:
• economic losses (including without limitation loss of revenues, data, profits, contracts, business or anticipated savings); or
• loss of goodwill or reputation; or
• special or indirect losses
• suffered or incurred by that party arising out of or in connection with the provisions of any matter under these terms and conditions.
11.5 Notwithstanding the above, subject to Section 11.1 SASAKI’s aggregate liability (whether in contract, tort or otherwise) for loss or damage shall, in any event, be limited to a sum equal to the amount paid or payable by you for the product(s) in respect of one incident or series of incidents attributable to the same clause.
11.6 This clause 7 does not affect your statutory rights as a consumer, nor does it affect your contract cancellation rights.
11.7 We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.
12. Miscellaneous Provisions
12.1 The contract between us shall be governed by the laws of England and any dispute between us will be resolved exclusively in the courts of England. English is the only language offered for the conclusion of the contract.
12.2 We have selected our product on the basis that they will be used for domestic use only. If you are planning to use them for business purposes please make sure that you are covered by the appropriate insurance. Where you decide to use the product in the course of a business, we exclude (to the fullest extent permitted by law) those warranties and conditions relating to fitness for a particular purpose. Our maximum liability to business users arising out of or in connection with the product shall be limited to the replacement value of the product in question (except in the case of death or personal injury caused by our negligence or in respect of fraud). In relation to business users, we do not accept liability for the fitness of goods for business purposes, nor do we accept liability for loss of use of the item nor any loss over and above the cost of the item in the event of a claim for breach of warranty or condition.
12.3 SASAKI shall be under no liability for any delay or failure to deliver a product or otherwise perform any obligation as specified in these terms and conditions if the same is wholly or partly caused whether directly or indirectly by circumstances beyond its reasonable control.
12.4 To provide increased value to our customers, we may provide links to other websites or resources for you to access at your sole discretion. You acknowledge and agree that, as you have chosen to enter the linked website we are not responsible for the availability of such external sites or resources, and do not review or endorse and are not responsible or liable, directly or indirectly, for (i) the privacy practices of such websites, (ii) the content of such websites, including (without limitation) any advertising, content, products, goods or other materials or services on or available from such websites or resources or (iii) the use to which others make of these websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such advertising, content, products, goods or other materials or services available on such external websites or resources.
12.5 You may not assign or sub-contract any of your rights or obligations under these terms and conditions or any related order for products to any third party unless agreed upon in writing by SASAKI.
12.6 SASAKI reserves the right to transfer, assign, novate or sub-contract the benefit of the whole or part of any of its rights or obligations under these terms and conditions or any related contract to any third party.
12.7 None of these terms affect your legal rights and these are not diminished in any way. If any term is held to be invalid under any applicable statute or rule of law, that term is automatically omitted from the terms to minimum extent necessary to comply with the law and without affecting the validity or enforceability of the remainder.
